Terms and conditions

  1. These Terms and Conditions (Terms) apply to the Sport Volunteer Awards (Awards) organised by Sport and Recreation New Zealand (Sport NZ). You agree to be bound by these Terms:
    1. by sending an eCard or nominating a sport volunteer for an award (Nominator);
    2. if you receive an eCard nominating you for an award and you ‘opt-in’ via the link provided in the eCard (Nominee).
  2. instructions headed ‘THANK-YOU AND NOMINATION FORM’ on the hard copy individual and group entry form and online entry form at www.sportnz.org.nz/volunteers form part of these Terms.
  3. Sport NZ operates the Awards and has a delivery partnership with New Zealand’s 17 regional sports trusts (each a Regional Sports Trust). MediaWorks NZ Limited (MORE FM) sponsors the Awards nationally. Other sponsors may exist regionally and differ from region to region. For information on local sponsorships contact your Regional Sports Trust.

    Nominators

  4. As a Nominator, you undertake and confirm that:
    1. you live in New Zealand;
    2. you believe that the sport volunteer that you nominate will be happy for Sport NZ to contact him or her using the information you provide as part of the nomination; and
    3. all information you provide as part of any nomination is true, accurate and complete and is not in any way offensive, malicious, objectionable or defamatory and does not infringe any rights of any other person.
  5. You can thank or nominate more than one sport volunteer, but you cannot nominate the same person more than once. A volunteer can be thanked and nominated by more than one person.

    Nominees

  6. To be a valid Nominee (that is eligible for any award or prize under these Terms), you must:
    1. nominated using a hard copy or online nomination form that:
      1. includes all required information;
      2. has been submitted by a valid Nominator; and
      3. is received by Sport NZ between 12:01am on 18 June and 11:59 pm on 28 August 2012;
    2. receive an eCard setting out the details of your nomination;
    3. ‘opt in’ before 11:59 pm on 2 September 2012 by:
      1. approving the nomination via the link provided in the eCard received by you; and
      2. providing all required information, including an email address and phone number contact details;
    4. live in New Zealand;
    5. not be an employee (or an immediate family member of an employee) of Sport NZ, any Regional Sports Trust, MORE FM or any sponsor organisations or agency associated with the Awards; and
    6. comply with these Terms.


    Awards and Prizes

  7. In relation to each region, Sport NZ and the relevant Regional Sports Trust will appoint a judging panel for that region (Regional Judging Panel). Each Regional Judging Panel may select:
    1. A number of Regional Finalists (Regional Finalists) who will be invited to gather for the announcement of winners;
    2. up to three valid Nominees from within that region as winners (Regional Winners) who will each receive a $250 sports store voucher (subject to clause 8); and
    3. from the Regional Winners (if any) a National Nominee (National Nominee) for the title of New Zealand Sport Volunteer of the Year (National Winner).
    Each Regional Judging Panel will have absolute discretion in selecting Regional Finalists, Regional Winners and the National Nominee. In the absence of suitable Nominees, a Regional Judging Panel may choose to select fewer than three or no Regional Winners and/or no National Nominee.
  8. Regional Finalists and Regional Winners must attend such award ceremonies and media and promotional events (if any) as are reasonably required by their Regional Sports Trust. Any Regional Winner that fails to do so may be deemed to have forfeited his or her award and prize which may be awarded to an alternative Nominee, at the Regional Judging Panel’s discretion.
  9. Sport NZ, the Regional Sports Trust or MORE FM will attempt to contact each Regional Finalist and/or Regional Winner using the contact details provided by, or in relation to, that Nominee. If a Nominee cannot be contacted within one week, he or she will be deemed to have forfeited his or her prize and the Regional Judging Panel may choose an alternative Regional Finalists and Regional Winner if it considers there are other worthy Nominees.
  10. Sport NZ will appoint a judging panel to select the winner of the national title of New Zealand Sport Volunteer of the Year (National Winner) from the Regional Nominees. On selecting that person, he or she will be contacted and must promptly confirm:
    1. his or her identity with valid identification such as a passport, drivers licence or birth certificate;
    2. that he or she will be available to attend the New Zealand Sport and Recreation Awards (date and location to be confirmed) in 2013 to be presented with a trophy and may be asked to speak briefly on his or her volunteering experiences; and
    3. that he or she will be available for interviews, photos and other media and promotional events in relation to the Awards.
    If If the National Winner cannot be contacted or does not confirm the above, the Sport NZ judging panel may select and contact an alternative Regional Nominee until a suitable person is selected that is able to confirm the above. The Sport NZ judging panel has absolute discretion in selecting the National Winner and may determine that there are no suitable Regional Nominees.
  11. Sport NZ will pay for domestic travel costs and accommodation costs if required by the National Winner to attend the New Zealand Sport and Recreation Awards.
  12. The prizes described in these Terms may not be exhaustive and Regional Finalists, Regional Winners, the National Winner, and other Nominees may be awarded additional prizes or rewards at the discretion of Sport NZ, the Regional Sports Trusts or Sponsors.
  13. No prize is redeemable for cash or transferable. If you win a voucher and you are not able to access the relevant sports store or online store to redeem that voucher, Sport NZ may (but is not obliged to) arrange a replacement voucher from an alternative store of the same value, provided the prize voucher is first returned to Sport NZ. Voucher prize values include GST.
  14. The decisions of the regional and national judging panels are final. No correspondence will be entered into. Contact the relevant Regional Sports Trust for information on the judging and announcement/event dates in your region.
  15. Nominees who have volunteered for 25+ years will be inducted into regional halls of fame, subject to the approval of the applicable administering Regional Sports Trust. If the applicable regional sports trust deems inclusion of a volunteer would bring their organisation, Sport NZ or the Hall of Fame itself into disrepute the regional sports trust reserves the right to decline inclusion. Regional Sports Trusts may consult with applicable regional or national sporting bodies when assessing inclusion. A regional sports trust’s decision is final and no correspondence will be entered into.

    Personal Information

  16. Sport NZ may provide the Regional Sports Trusts for your region and MORE FM your contact details and any other personal information about you received by Sport NZ in relation to the Awards (Personal Information) if you are a:
    1. Nominator that has nominated a Nominee that has ‘opted in’ in accordance with clause 6: or
    2. Nominee that has ‘opted in’ in accordance with clause 6.
  17. Sport NZ will (and will use reasonable efforts to ensure each Regional Sports Trust and MORE FM will) only use your Personal Information for the purpose of the Awards and otherwise in accordance with these Terms. Sport NZ may provide your Personal Information to third party contractors who assist Sport NZ to run the Awards, but only for that purpose.
  18. If you are a Nominee that has ‘opted-in’, or if you nominated a Nominee that has ‘opted-in’, you agree that Sport NZ, the Regional Sports Trust for your region and MORE FM may contact you for the purposes of on-air, online, and in-person promotional activity. You waive any expectation of compensation from MORE FM, Sport NZ or the Regional Sports Trust for the reasonable use of your image, voice, or volunteer story on-air or in publications and online.
  19. If you receive a nomination eCard and ‘opt-out’ via the link provided, or fail to ‘opt-in’ before 11:59pm on 2 September 2012, Sport NZ will not use your Personal Information again without your consent.
  20. You agree that all copyright and other rights in any information you provide in relation to the Awards vests in Sport NZ.
  21. Pursuant to the provisions of the Privacy Act 1993, all Personal Information of Nominators and Nominees will be stored by Sport NZ at Sport NZ’s head office: 86 Customhouse Quay, Wellington. Any request to access, update or correct any Personal Information held by Sport NZ should be directed to Sport NZ. You will need to separately contact your Regional Sports Trust and MORE FM to request to access, update or correct any Personal Information held by them.

    General

  22. Sport NZ reserves the right to refuse to grant any award or prize where it considers, in its sole discretion that a Nominee or Nominator has breached these Terms, has acted fraudulently or may otherwise bring the Awards, Sport NZ, MORE FM or any Regional Sports Trust into disrepute.
  23. Sport NZ reserves the right to amend, vary, extend or discontinue these Terms and/or the Awards at any stage, for any reason.
  24. Sport NZ, the Regional Sports Trusts, MORE FM and each sponsor will not be responsible or liable for:
    1. any late, lost or misdirected entries or for any inability to enter, complete, continue or conclude the eCard or nomination process for any reason, including (without limitation) any equipment or technical malfunction, Acts of God or otherwise;
    2. any malicious, illegal, offensive, dishonest or incorrect information included in any eCard or nomination; or
    3. any loss, damage or injury of any kind whatsoever which is suffered or sustained (directly or indirectly) by any award or prize winner in connection with any prize or award, except for any liability which cannot be excluded by law.
